For years, a significant portion of our litigation practice has involved reversing fraudulent transfers. In most of these cases, someone has taken an elder or incompetent person's money and we get it back.

In recent years, the real victims of elder financial abuse have been nursing homes and other caretakers. As a result, AndoverLaw, P.C. represents nursing homes and other entities in matters related to the fraudulent transfer of assets. Typically, a family member or 'friend', with or without the competent assistance of the resident, transfers assets from the nursing home resident to himself/herself. The resident is left with no assets and does not qualify for MassHealth (Medicaid) as a result of the fraudulent transfer. The facility is left in the position of providing free care to the resident who cannot be safely discharged back into the community.
